Joe is a founding partner at Garcia Legal, PA, and currently represents various major corporations, insurance carriers, and business entities in all forms of insurance and commercial litigation disputes.  He also serves as General Counsel for a major credit union and several international airfreight brokers/forwarders. He is a seasoned South Florida trial attorney—with $0.00 dollar, full defense verdicts for his insurance clients.

After graduating from Florida International University and St. Thomas School of Law, Joe honed his skills at a prestigious litigation boutique, where he specialized in government entity defense (Miami-Dade and Indian River County School Boards, various community colleges, City of Hollywood, and the City of Aventura) through their insurance carriers (AIG, Travelers, ACE USA, Nova).

He is the author of numerous appellate briefs; including a successful appeal to the 11th Circuit District Court of appeal while defending a South Florida community college (finding that Florida sovereign immunity applies to community colleges as instrumentalities of the State).   His expertise in handling insurance related liability matters allowed Joe to expand into the areas of employment law, EEOC actions, Federal/State discrimination and Whistle-blower actions (E&O policies), construction defect (CGL policies).

In the areas of First Party Property defense for Citizens Property Insurance, and his portfolio of private homeowners insurance carriers (Defense and EUO), and Third Party liability defense for large commercial insurance carriers (CGL Polices; E & O Liability).  Joe’s clients often call on him to provide litigation defense, SIU services, coverage opinions, and legal memorandums as special assignments.

Joe is Cuban-American and speaks Spanish with native fluency—an important advantage in South Florida.  He is a member in good standing of the Florida Bar, and is accepted to practice in all three Federal District Courts in Florida (Southern, Middle, and Northern), and is also member of the Federal Eleventh Circuit Court of Appeal.

Victor R. Garcia is a Partner and managing attorney of the firm’s Commercial Claims Litigation department.

Victor has practiced in the area of commercial claims litigation and creditors’ rights for over nine years. He deals mainly with accounts receivables, commercial loans, and contractual disputes for a variety of creditors, including lenders, finance companies, major corporations, insurance companies and small businesses. He has extensive experience in the domestication and collection of judgments in counties throughout the State of Florida and the recovery of secured collateral through the judicial process.  He currently manages the firm’s Commercial Claims Litigation department, which handles a large volume of cases forwarded from clients throughout the United States and Canada.  He also handles various bankruptcy matters, representing creditors to ensure their claims are addressed in those proceedings and securing any recovery possible.

Victor is a longtime member of the Commercial Law League of America, where he has served on the Executive Council of the Young Members’ Section since 2012.  He is also an inaugural affiliate member of the Commercial Collection Agencies of America.

He has recently expanded his practice as counsel for several insurance companies, financial institutions and other corporations to include civil litigation defense in first party property and premises liability claims.

Victor also represents parties in residential and commercial real estate transactions and litigation.  He is a title agent and member attorney of the Attorneys’ Title Insurance Fund and Old Republic Title Insurance Company.

Victor attended the Saint Thomas University School of Law, where he was the Articles Editor of the Law Review and member of Phi Delta Phi Legal Honors Fraternity.
